Loss Of June's Rent On Rental Unit?

I am trying to do the right thing here with my agent. He leased a duplex unit for me and the application was false. The girl put a stop payment on the $900 money orders she gave him for rents , security deposits and a partial pet deposit. In the mean time he sent me a check for the security deposit and the partial pet deposit, less 80% commission fee for her first months rent. Then he told me two weeks later to file an Eviction on her because a stop payment was made on the money orders and something about the reason was because they were a year old. I paid to file an Eviction and go to court on July 6th. Do I need to give him his check back since the money orders were not any good?
